APPLICANTS FOR INTERNATIONAL PROTECTION

International Protection

After arriving to the Czech Republic, anyone persecuted in their country of origin may apply for the international protection, which is granted either in the form of asylum or additional protection. Before granting the international protection, the Ministry of the Interior investigates whether the applicant was persecuted in the country of origin for any of the following reasons:

  • exercising their political rights and freedoms
  • race
  • gender
  • religion
  • nationality
  • membership in a particular social group
  • advocating a political opinion in the state whose citizens they are, or the country of their former permanent residence in case of a stateless person.


Asylum
The Czech Republic will grant asylum to a person who proves that they were persecuted in their home country for any of the following reasons: exercising political rights and freedoms, race, sex, religion, nationality, membership in a particular social group, or advocating their political opinion in the state whose citizens they are, or the country of their former permanent residence in case of a stateless person.
Another reason for granting the international protection is reuniting with a family member (spouse, minor child, or a parent – if the applicant is a minor child) who has been granted asylum.
The last group of reasons are the so-called humanitarian reasons. It is purely at the discretion of the Ministry of the Interior, to whom and for what reasons the humanitarian asylum will be granted, and the Ministry is not legally bound to granting it.


Additional Protection

In case the applicant fails to provide sufficient grounds for being granted asylum, they can receive additional protection, when they prove that if repatriated, they would be in danger of the sentence or execution of death penalty, torture or inhuman or degrading treatment or punishment, or that back in their home country, their life or human dignity would be at risk, or that they would find themselves in a situation of international or internal armed conflict, or if their departure from the Czech Republic would be against the country’s international obligations.
Additional protection can also be granted for the reason of reuniting with a family member (spouse, minor child, or - in case the applicant is a minor child - a parent), who was granted additional protection.
Unlike asylum, additional protection is granted for a fixed period, after which the reasons for granting it are reviewed. If the reasons continue, it will be renewed.
The extension must be applied for at least 30 days before the expiry of the additional protection.
