Third-instance authority: Supreme Administrative Court

If you file a cassation complaint (sent directly to the Supreme Administrative Court), you must visit the Department for Asylum and Migration Policy (OAMP) to provide:

  • Your travel documents (if applicable)
  • A copy of the cassation complaint
  • Proof of timely submission of the cassation complaint, including a request for suspensive effect (or proof of an extended period of sufferance, if applicable, and confirmation that suspensive effect has been granted), along with evidence that the cassation complaint proceedings have not effectively concluded
  • Proof of submission of the cassation complaint to the court (e.g. a postal receipt with the post stamp and date of sending, or the court’s filing office stamp if submitted in person)
  • Proof of your reported address of residence (e.g. your lease agreement)

You will then be issued a certificate of residence in the territory on sufferance, valid for the duration of the proceedings at the Supreme Administrative Court (SAC). Once the SAC’s decision on the cassation complaint is delivered to your advocate, it becomes final, marking the end of the international protection procedure and the expiration of your sufferance permit.

You must report to the Department of Asylum and Migration Policy without undue delay – no later than one month after the SAC’s decision is delivered to your lawyer. There you will be issued a departure order.

The SAC proceedings are conducted in writing only, and the court evaluates whether the international protection procedure (at both the administrative authority and the court of appeal) was carried out in compliance with the law and international conventions.

Representation by a lawyer is mandatory for these proceedings. If you cannot afford legal representation, you may request the court to appoint a lawyer free of charge.

You remain insured throughout these proceedings.

Housing – if you are unable to secure accommodation, you must apply to the Refugee Facilities Administration for assistance.
